Interim version 1. Effective 23 September 2026. These terms apply until our solicitors finish reviewing them. We will tell you before any change takes effect.
TheGemMint Ltd (company number 17200360, registered in England and Wales, registered office 66 Paul Street, London EC2A 4NA) ("we", "us") runs the TheGemMint marketplace. These terms apply to you if you sell on TheGemMint as a business (a "trader"). They apply in addition to our Terms of Service. If the two conflict, these terms apply to your sales as a trader.
1. Are you a trader?
1.1 You are a trader if you sell for purposes relating to your trade, business, craft or profession. Signs include: you buy cards or sealed products in order to resell them, you sell regularly or in volume, you run a shop or stall online or in person, or you are a company, sole trader or VAT-registered business selling stock.
1.2 You are a private seller if you are selling items from your own collection now and then, not as a business.
1.3 If you are not sure which you are, contact us before you list. It is against the law for a business to present itself as a private seller.
2. Telling us, and what buyers see
2.1 Before you list as a trader, you must tell us that you sell as a business and give us:
- your business or trading name;
- a geographic address in the UK where you can be contacted;
- an email address for customers;
- your company number and VAT number, if you have them.
Until the business seller setting is live in your seller settings, send these details to support@thegemmint.co.uk.
2.2 We will show buyers that you are a business seller, together with these details, on your listings and your seller page.
2.3 Keep your details accurate. Tell us straight away if they change, or if you stop or start selling as a business.
3. Your customers' legal rights
When you sell to a consumer as a trader, the law gives the buyer rights that you must honour. You cannot exclude or limit them.
3.1 Goods as described. Items must match their description and photos, be of satisfactory quality and be fit for purpose (Consumer Rights Act 2015). Describe condition, grade, language, edition and any flaws accurately.
3.2 14 days to cancel. A buyer can cancel for any reason within 14 days from the day they receive the item (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013). You must refund the item price and the standard postage they paid within 14 days of getting the item back, or of receiving evidence that it was sent back, whichever comes first. You may deduct an amount for any loss in value caused by handling the item more than was needed to check it.
3.3 Return postage. State in your listing or on your seller page who pays for return postage. If you do not say, you pay it.
3.4 No "no returns". Do not write "no returns", "sold as seen" or anything else that suggests buyers lose these rights.
3.5 Information before purchase. The law requires buyers to be given certain information before they buy. The listing page, your seller page and our checkout carry most of it. You are responsible for your part, such as accurate descriptions and your return postage terms.
4. How cancellations and refunds work on TheGemMint
4.1 A buyer who wants to cancel contacts you through TheGemMint messages or contacts our support. You must reply within 2 working days.
4.2 Refunds on trader sales are made through TheGemMint. You authorise us to refund the buyer on your behalf where the law requires it, and to recover that amount from you, including from your Stripe balance, from your future payouts, or by charging you.
4.3 You must take part in our dispute process and follow its outcome.
5. Listings and conduct
5.1 Only list genuine items that you have. Do not list counterfeit, fake or unofficial reproduction items.
5.2 Pricing, fees and postage work as set out in our Terms of Service and on our fees page.
5.3 Dispatch within the time our Terms of Service set (currently 3 working days from payment), using the postage method shown on the order.
5.4 Do not write, buy or arrange fake reviews, and do not review your own sales.
6. Tax, VAT and reporting
6.1 You are responsible for your own tax and VAT. If you are VAT registered, your prices must include VAT, and you must give a VAT invoice when a buyer asks for one.
6.2 UK law requires us to collect certain information about sellers and, above set thresholds, to report sellers' sales to HM Revenue & Customs (the Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023). You must give us accurate information when we ask for it. We may pause your selling or payouts until you do.
7. Payouts
7.1 Payouts work as set out in our Terms of Service and are made to your verified Stripe account.
7.2 We may hold or deduct from payouts where needed to cover refunds, cancellations or chargebacks on your trader sales.
8. Responsibility
8.1 You are responsible for your sales and for complying with consumer law.
8.2 You agree to cover our reasonable costs and losses if a buyer or a regulator brings a claim against us because you broke these terms or the law.
8.3 If you break these terms, we may remove listings, pause payouts, or suspend or close your selling account.
9. Changes and law
9.1 We may change these terms by giving you at least 30 days' notice by email and on this page.
9.2 These terms are governed by the law of England and Wales.
9.3 Questions: support@thegemmint.co.uk.
