Account terms
To list items or make purchases you must create a TheGemMint account. By creating an account you confirm that:
- You are at least 18 years old.
- You are resident in the United Kingdom. (International accounts will be supported in a future release.)
- The information you provide is accurate, current, and complete.

We may suspend or close accounts that violate these Terms, that we reasonably suspect of fraud, or that have been inactive for a continuous period exceeding 24 months.
Listings & sales
Sellers are responsible for the accuracy of every Listing they publish, including images, condition, grading details, set, edition, and price. TheGemMint does not authenticate items prior to listing; we provide tools to help Buyers and Sellers transact in good faith.
Accuracy of condition grading
Where a Listing references a third-party grading service (e.g. PSA, BGS, CGC), the Seller warrants that the grade shown corresponds to the physical item being shipped, and that the grading slab has not been tampered with.
Withdrawal of Listings
We reserve the right to remove Listings that breach these Terms, the law, or the rights of third parties (including the intellectual-property rights of card publishers).
Fees & promotion fees
Selling on TheGemMint is subject to a platform fee, deducted from the sale price when the Buyer pays:
- Standard seller fee: 2.5% of the sale price, reduced to 2% on the Essentials plan and 1.5% on Growth.
- Founder members: 0% seller fee on the first £2,000 of lifetime sales (GMV), then the seller fee for their plan as set out above.
Buyers pay a 5% fee on the item price, folded into the displayed price of each item, plus a flat 30p per seller-order. The flat part is charged once per Seller in an order, never once per item, and is itemised at checkout.
There is no minimum fee. A minimum total fee of 35p per seller-charge applied until 16 August 2026 and was withdrawn on that date; no fee floor has been applied since.
Payment processing charged by Stripe (1.5% + 20p for UK cards at launch) is absorbed by TheGemMint out of the platform fee. It is not charged separately to the Buyer and is not deducted from the Seller's payout.
Sellers may optionally pay a promotion fee to surface their Listing in featured slots; promotion fees are quoted at point of purchase and are not refundable once the promotion has begun.
First-order offer. Your first order: just the card price. No fees, free delivery. For the first 60 orders, until 23:59 on 30 November 2026 (UK time). One per person and delivery address, on one seller's order sent with tracked delivery.
Referral gift. £5 off your first card with a friend's code. On a card price of £25 or more (the cards from one seller, before fees and postage): a new member's first such order, or an existing member's next one after adding a code. Once per member, and one per person, delivery address and card; not with your own code, nor to an address or with a card of the member whose code it is. For the first 50 gifts. It can be used together with the first-order offer. The Seller's payout is unchanged: TheGemMint pays the £5 into the Seller's Stripe account.
Payment & payout
All payments are processed via Stripe Connect. To receive payouts you must complete Stripe's onboarding flow, which includes identity verification and bank-account linking. By using TheGemMint you also agree to Stripe's Connected Account Agreement.
Where the money goes. Payment for an order is taken at checkout and paid into the Seller's Stripe account at that moment. TheGemMint does not hold Buyer funds and does not operate an escrow account. The Seller's share is paid out from their Stripe balance to their bank when the order completes, 14 days after delivery or sooner where the Buyer confirms receipt, and not before. Stripe's standard payout timing then applies to when it arrives in the bank.
What protects the Buyer. The Buyer may raise a dispute on the order page for 14 days from delivery. Where we decide a dispute in the Buyer's favour we refund the Buyer, and Stripe recovers that refund from the Seller's Stripe balance, except for a lost parcel covered by section 08 (Lost parcels), where TheGemMint pays the refund and nothing is recovered from the Seller. A Buyer may end that period early by confirming receipt, after which the order is complete and no further dispute may be raised through TheGemMint.
Nothing in this section affects a Buyer's right to raise a chargeback with their own card issuer, or any right they have under UK consumer law.
TheGemMint never holds Seller funds; payouts flow directly from Stripe to the Seller's linked bank account.
Prohibited items
The following items may not be listed on TheGemMint:
- Counterfeit, replica, or reprinted cards not clearly disclosed as such.
- Cards with altered grading slabs, swapped contents, or otherwise misrepresented authenticity.
- Cards stolen or otherwise obtained unlawfully.
- Any item where the sale would breach UK law or the intellectual-property rights of a third party.
Violations may result in immediate Listing removal, refund to the Buyer, and account suspension or closure.
Shipping & delivery
TheGemMint buys the postage label on tracked orders, which is how orders are sent unless a listing is marked as sent without tracking. On a tracked order the Seller does not choose a carrier, buy postage, or enter a tracking number, and tracking is attached to the order automatically. Both postage speeds we buy are Royal Mail Tracked services.
The Buyer chooses the delivery speed at checkout. The Seller chooses how to hand the parcel over: Post Office drop-off, Royal Mail Parcel Collect printing the label at home, or Royal Mail Parcel Collect with the label brought to their door. Doorstep collection carries Royal Mail's collection charge, which comes out of the Seller's payout. Drop-off costs the Seller nothing.
Sellers must dispatch within 3 working days of payment confirmation.
A Seller may mark a listing priced at £10.00 or less as sent without tracking. On those orders no label is bought, the Buyer pays a flat untracked postage rate, and the Seller posts the item themselves and keeps a proof of posting. The Buyer sees that notice before buying, and because there is no delivery scan the Buyer's window to report a problem runs 14 days.
Where the cards in a tracked order from a single Seller come to £75.00 or less, postage is a flat price shown before checkout and the carrier's included cover of £75.00 applies. Where they come to more than £75.00, the order is sent signature-on-delivery and covered for its full value. That cover is compulsory, it is priced by the carrier on the day, and it is charged to the Buyer in the postage line at checkout. Free postage, and any free-postage threshold a Seller has set, do not apply to those orders.
We cannot post an order where the cards from a single Seller come to more than £10,000, which is the carrier's own limit.
Risk of loss passes to the Buyer on delivery. On a tracked order TheGemMint buys the label, so TheGemMint is the carrier's customer and is the only party who can claim against the carrier. Where a tracked order is lost or damaged in transit, the Buyer should report it from their order page within the dispute window and TheGemMint will make the carrier claim. Except as set out under Lost parcels below, the outcome for the Buyer is decided under Refunds & disputes below. Sellers must not arrange their own postage for an order sent on a TheGemMint label.
Lost parcels. If a tracked parcel sent on a TheGemMint label is lost after the carrier has scanned it in, the Buyer gets a full refund and the Seller is paid for the sale as if it had arrived. TheGemMint pays that refund, not the Seller, and claims from the carrier. This applies when the Seller dispatched within 3 working days of payment confirmation, on that label, with the item packed properly. A parcel the carrier never scanned in, and an order sent without tracking, are dealt with under section 09 (Refunds & disputes).
Refunds & disputes
Buyers have 14 days from the marked-delivered date to raise a dispute via the order page. Valid dispute reasons include: item not as described, incorrect grade, missing components, evident damage on arrival, or non-delivery.
An open dispute suspends the order: it cannot complete while the dispute is live, so the Seller cannot end the Buyer's window by waiting it out. TheGemMint will mediate in good faith; for sales above £500 we may require photographic evidence of the slab serial number before deciding. Where the decision goes to the Buyer we refund them, and Stripe recovers that refund from the Seller's Stripe balance, except for a lost parcel covered by section 08 (Lost parcels), where TheGemMint pays the refund and nothing is recovered from the Seller.
Outside that window, refunds are at the Seller's discretion.
Liability
To the maximum extent permitted by law, TheGemMint's liability to any User in connection with a transaction is limited to the amount of the platform fee earned on that transaction.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under English law.
Termination
You may close your account at any time via Account Settings, provided you have no open orders. We may suspend or terminate accounts that materially breach these Terms; in such cases, any pending payouts remain payable to the Seller subject to dispute resolution.
Governing law
These Terms and any dispute arising under them are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, save that we may bring proceedings in any jurisdiction where you are domiciled to enforce a court order or judgment.
