Interim version 2. Effective 6 October 2026. These terms apply until our solicitors finish reviewing them. We will tell you before any change takes effect.
TheGemMint Ltd (company number 17200360, registered in England and Wales, registered office 66 Paul Street, London EC2A 4NA) ("we", "us") runs the TheGemMint Referral Programme. These terms apply alongside our Terms of Service and Privacy Policy. If they conflict on anything about referrals, these terms apply. If you have a separate written creator or influencer agreement with us, that agreement applies instead wherever it covers the same point.
1. Who can take part
1.1 Any member with a TheGemMint account in good standing can take part. You must be 18 or over and live in the UK.
1.2 Each member has one referral code and one share link. Your code is personal to you. You must not sell, swap or transfer it.
2. How a referral is made
2.1 A person becomes your referred member when they create a TheGemMint account through your share link, or enter your code at sign-up or at their checkout, and they have not already been referred by someone else.
2.2 Each member can only ever have one referrer. The first valid code wins and cannot be changed later.
2.3 You cannot refer yourself, an account you control, or someone who already has a referrer. The programme has one level only: you earn on the people you refer, not on the people they refer.
2.4 Your referred member stays linked to you while both accounts stay open and in good standing and the programme is running.
3. What you earn
3.1 You earn 15% of what TheGemMint keeps on each completed trade by your referred member ("net fees").
3.2 Net fees means the fee we charge on your referred member's side of the trade (the seller fee when they sell, the buyer fee when they buy), less the share of the card processing cost we pay on that trade. It does not include the item price, postage, or any amount we pass on to someone else.
3.3 If the seller and the buyer in one trade were referred by different people, each referrer earns only on their own side. The total we pay on one trade is never more than 15% of our net fees on it.
3.4 If we charge no fee on a side, for example a founder seller in their 0% fee period, there are no net fees on that side and no commission on it. Your dashboard shows when this applies.
3.5 All amounts are in pounds sterling and include VAT, if any applies.
4. When commission is confirmed
4.1 Your dashboard shows every amount in one of four states:
- Pending: the trade is paid, but our card processing cost for it is not confirmed yet (usually within a day).
- Confirmed: the cost is confirmed, but the trade's refund and dispute window is still open.
- Ready to pay: the refund and dispute window has closed.
- Reversed: the trade was refunded, disputed or charged back. Reversed commission is not payable.
4.2 A card chargeback can arrive after the window has closed. If it does, we reverse the commission on that trade. If we have already paid it to you, we deduct it from your future commission.
5. Payouts
5.1 Payouts are open. Your commission builds up in your dashboard until you ask to withdraw it.
5.2 You are paid through Stripe into a payout account you set up on TheGemMint. It is the same setup sellers use, and it verifies your identity. You can ask to withdraw when your Ready to pay balance is £25 or more. We review every request and usually pay within 7 days. Stripe then pays your bank.
5.3 You are responsible for any tax on what you earn. Where the law requires it, we may report payments to HM Revenue & Customs.
6. Promoting your link
6.1 Be honest. Do not make claims about TheGemMint, its prices or its fees that are untrue or misleading, and do not promise anything on our behalf.
6.2 Because you earn commission, anything you post to promote your code or link is advertising. Label it clearly on every post, for example with "#ad" at the start.
6.3 You must not send spam, message people who have not agreed to hear from you, bid on the TheGemMint name in paid search ads, pretend to be TheGemMint, or create fake or duplicate accounts.
6.4 You must not trade with yourself, or with accounts you control or arrange, to earn commission.
7. Abuse
7.1 If we reasonably believe you have broken these terms or abused the programme, we may withhold or reverse commission, remove your code and end your part in the programme, and in serious cases suspend or close your account. We will tell you why unless the law stops us.
8. Privacy
8.1 Your dashboard shows totals only. We never show you who your referred members are, what they bought or sold, or any of their personal details.
8.2 We handle referral data as set out in our Privacy Policy.
9. Changes, closing your account, and ending the programme
9.1 We may change these terms, including the commission rate, by giving you at least 30 days' notice by email and on this page. A change applies only to trades completed after it takes effect. Commission you have already earned is not affected.
9.2 We may suspend or end the programme by giving you at least 30 days' notice. Commission earned before the end date will still be confirmed and, once payouts are open, paid when your Ready to pay balance is £25 or more.
9.3 If you close your account, we will pay a Ready to pay balance of £25 or more once payouts are open. A balance under £25 is not paid.
10. General
10.1 Taking part does not make you our employee, agent or partner.
10.2 Nothing in these terms affects your legal rights as a consumer.
10.3 These terms are governed by the law of England and Wales.
